Daily Violation definition

Daily Violation or “Daily maximum violation” shall mean (i) any exceedance of a daily discharge limit, as determined under applicable state or federal law, for any parameters set forth in ICG’s KPDES permits, and identified by a DMR Sample; (ii) any failure to attain a minimum daily discharge limitation for pH set forth in ICG’s KPDES permits, as determined under applicable state law, and as identified by a DMR Sample; or (iii) any
Daily Violation means (i) any exceedance of a maximum daily discharge limitation for any parameters set forth in Defendants’ NPDES permits, as determined by a Discharge Monitoring Report (“DMR”) Sample, or (ii) any failure to attain a minimum daily discharge limitation for pH set forth in Defendants’ NPDES permits, as determined by a DMR Sample. Exceedances of any daily maximum Selenium Limit and exceedances of any daily maximum discharge limitation for osmotic pressure by the Cumberland and Emerald Discharges are excluded from this definition.
Daily Violation means (i) any exceedance of a maximum daily discharge limitation, as determined under applicable state or federal law, for any parameters set forth in Defendants’ NPDES permits, and identified by a DMR Sample, or (ii) any failure to attain a minimum daily discharge limitation for pH set forth in Defendants’ NPDES permits, as determined under applicable state or federal law, and as identified by a DMR Sample;

Examples of Daily Violation in a sentence

  • Any sample taken after 48 hours of notification of the first Daily Violation that results in a Daily Violation for the same pollutant parameter at the same Outlet and is not subject to Paragraph 55(a)(iii) or 55(a)(iv) is a Category 2 Daily Violation.

  • Upon notification of the first Category 4 Daily Violation, Defendants shall hire a third-party consultant to examine the problem.

  • Any sample taken within 48 hours of notification of the first Daily Violation that results in a Daily Violation for the same pollutant parameter at the same Outlet is a Category 1 Daily Violation.

  • These stipulated penalties shall be in addition to those accruing under Paragraphs 116 and 117:Additional Penalty Per Daily Violation: $2,000 Additional Penalty Per Monthly Violation: $4,000 Violations of the Selenium Limits prior to the applicable Selenium Compliance Deadline shall not be counted for purposes of this Paragraph.

  • If Defendants implement an alternative plan to the consultant’s recommendations under Paragraph 55(a)(iv), stipulated penalties of $10,000 shall accrue for each subsequent Category 4 Daily Violation.

  • If a compliant DMR Sample result for the same pollutant parameter is not achieved at the Outlet within 48 hours of notification of the Daily Violation, Defendants shall also consult with an individual with substantial expertise in Clean Water Act compliance and in treatment systems for and control of relevant effluent parameters in Defendants’ NPDES permits, and implement any additional measures recommended by that individual.

  • Upon notification of the first Daily Violation at any Outlet, Defendants shall begin daily monitoring and Diagnostic Sampling of discharges and implement treatment measures until the Outlet returns to compliance (i.e., until one compliant DMR Sample result is achieved).

  • Any sample taken after 48 hours of notification of the first Category 2 Daily Violation that results in a Daily Violation for the same pollutant parameter at the same Outlet and is not subject to Paragraph 55(a)(iv) is a Category 3 Daily Violation.

  • Any sample taken after 48 hours of notification of the first Category 3 Daily Violation that results in a Daily Violation for the same pollutant parameter at the same Outlet is a Category 4 Daily Violation, until the Outlet returns to compliance (i.e., until one compliant DMR Sample result is achieved).

  • Upon notification of a Category 1 Daily Violation, Defendants shall immediately begin daily monitoring of conditions, Diagnostic Sampling, and implementing corrective measures at the Outlet.


More Definitions of Daily Violation

Daily Violation means (i) any exceedance of a maximum daily discharge limitation, as determined under applicable state or federal law, for any parameters set forth in NPDES permits applicable to any Facilities, which is identified by a DMR Sample, or
Daily Violation means (i) any exceedance of a maximum daily discharge limitation for any parameters set forth in Defendants’ NPDES Permits, as determined by a DMR Sample, or (ii) any failure to attain a pH measurement in accordance with the daily discharge limitation set forth in Defendants’ NPDES Permits, as determined by a DMR Sample.
Daily Violation means: (i) any exceedance of a maximum daily discharge limitation, as identified by a DMR Sample, for any parameters set forth in an NPDES permit applicable to the Facility, (ii) any failure to attain a minimum daily discharge limitation for pH, as identified by a DMR Sample, set forth in an NPDES permit applicable to the Facility, or (iii) any discharge of oil and grease in an amount that causes a film or sheen upon or discoloration of the receiving waters.

Related to Daily Violation

  • Market Violation means a tariff violation, violation of a Commission-approved order, rule or regulation, market manipulation, or inappropriate dispatch that creates substantial concerns regarding unnecessary market inefficiencies, as defined in 18 C.F.R. § 35.28(b)(8).

  • Daily Failure Amount means the product of (x) .005 multiplied by (y) the Closing Sale Price of the Common Stock on the applicable Share Delivery Date.
