To the extent the cause of such Central Plant unavailability or failure of the Thermal Energy to satisfy the Steam and Chilled Water Standards is not due to the breach by Seller of it's obligations under this Agreement, the cost of correcting the same shall be included in an amendment to the Current Contract Year O&M Budget pursuant to Schedule 4.2. Notification pursuant to this Section 3.4(b) shall be made in person or by telephone call and confirmed in writing.
The term "Free Corridor Amount" means if you have completed three Contract Years or attained age 59 and 6 months an amount equal to the excess, if any, of (i) 10% of the sum of the Annuity Account Value on the Transaction Date over (ii) cumulative prior withdrawals made pursuant to Section 2.07 in the current Contract Year or pursuant to the repayment of interest or principal on a loan, in the Current Contract Year.
If the Annuity Account Value is less than $10,000 on (a) the date of the application of the Annuity Account Value or Cash Value pursuant to Section 3.03 or (b) the date of termination of this Contract pursuant to Section 2.06 or 2.11, we will prorate the Annual Administrative Charge applicable to the completed portion of the Current Contract Year and withdraw such amount in lieu of the full Annual Administrative Charge described in this Section for the applicable part of that Contract Year.
In order to equitably distribute overtime hours in the manner described in paragraph 2, above, HUDS shall maintain a list that contains the following information about each bargaining unit member: • Bargaining Unit Seniority • Current Job Classification • Current Work Schedule • Current Work Unit • Telephone contact information as provided and updated by the member; and • Overtime Hours Accepted and Refused for the Current Contract Year.

Following the exchange of Distribution Proposals pursuant to Section 4.3(a) and any amendments thereto, the Parties shall negotiate in good faith to reach agreement on the Distribution for the Applicable Contract Year no later than March 31 of the Current Contract Year.
