In that event, the Board will have no further obligation to the CSFO except salary and benefits accrued before the resignation.
In this regard, the Board may request the CSFO to submit to medical examination or examinations by a physician or physicians selected by the Board and paid for by the Board, to determine whether he is physically and/or mentally capable of performing duties with or without reasonable accommodations.
In the event of such resignation, the CSFO shall provide the Board with at least three (3) months’ advance written notice prior to the effective date of his resignation.
If the CSFO does not provide at least three (3) months’ advance written notice of his resignation, the CSFO’s right to receive further payments of salary and benefits under this Contract may, at the election of the Board, terminate immediately upon notice of resignation to the Board.
The CSFO will be entitled to be reimbursed for all his customary and appropriate administrative and professional expenses.
The Board and the CSFO recognize that the CSFO may resign, with or without giving any reason therefore, at any time during the term of this Contract.
Should the CSFO become physically or mentally incapable of performing any substantial duty with or without reasonable accommodation permanently or for a period of ninety (90) calendar days, the Board may at its option, terminate the CSFO employment for disability.
The Board shall have the option of paying the amount due the CSFO through the effective date of his resignation as a lump sum releasing the CSFO from any further obligation to the Board.
The examining physician or physicians shall provide a confidential report to the Board regarding whether or not the CSFO is able to perform his duties with or without reasonable accommodations.
The CSFO shall obtain and maintain a valid and appropriate certificate to act as CSFO in the State of Alabama and meet the requirements to serve in that capacity set out in Alabama Code §16-13A-4(d) .
