Creditor's Obligations definition

Creditor's Obligations means collectively and includes (a) all present and future indebtedness, liabilities and obligations of any kind and nature whatsoever of the Borrower to the Creditor both now existing and hereafter arising under, as a result of, on account of, or in connection with, the Creditor's Loan, including, without limitation, obligations for the repayment of the Creditor's Loan, principal, interest, indemnities, fees, late charges, enforcement costs and other costs and expenses whether direct, contingent, joint, several, matured or unmatured; and (b) all present and future indebtedness, liabilities and obligations of any kind and nature whatsoever of the Guarantor to the Creditor both now existing and hereafter arising under, as a result of, on account of, or in connection with, the Creditor's Guaranty, including, without limitation, obligations for the guaranty of payment of the Creditor's Loan.

  • The Collateral Agent may deem and treat each Creditor as the owner of such Creditor's Obligations for all purposes hereof unless and until the Collateral Agent is notified of a change in Creditors.
