Crafter will have no obligations under this section if, as of the Order Form Effective Date of an applicable Order Form, Company has received notice of allegations of infringement or is engaged in litigation concerning the subject matter of what would otherwise be a Claim under this Agreement or with respect to a product substantially similar to the Software.
Crafter reserves the right to suspend or cancel performance of all or part of the Support Services, modify or revoke all or part of Company’s license rights in the Software, and/or change its credit terms if actual payment has not been received within thirty (30) days of the invoice date.
