Any land agreed to be acquired hereunder shall comprise CPO Land.
The Council is satisfied that it may be necessary in order for the Developer to carry out the Development to consider the need to exercise its CPO powers for those parts of the CPO Land that are not acquired by the Developer by private treaty and the Council accept that it may be necessary to make one or more CPO's to secure the acquisition of those parts of the CPO Land which have not been acquired by private treaty.

Following the agreement of the extent of any such CPO Land pursuant to clause 12.1 the Council Parties will use all reasonable endeavours to acquire such CPO Land and the Council shall give due consideration to use of its CPO Powers to facilitate acquisition of such CPO Land.
