Upon receipt, Spirent will use commercially reasonable efforts to fix the Error and return the Covered Goods to You.
You must comply with all packing and shipping requirements with respect to the Covered Goods.
You must follow Spirent’s prescribed process for returning physical Covered Goods for repair, maintenance or calibration pursuant to this Support Agreement.
Product Standards: The Covered Goods shall comply with or exceed the standards set forth on Licensor’s safety data sheets.
If Licensee and/or customer, in good faith, determine that all or a portion of the Covered Goods are non-conforming, Licensee and/or customer may return the Covered Goods to Licensor at Licensor’s expense.
For sales made by QuickSilver to an authorized distributor or directly to a customer, this Warranty Period shall be two (2) years for standard products and one (1) year for IP65 rated products and shall begin when the Covered Goods are received by such distributor or direct customer from QuickSilver.
The remedy will consist of repair or replacement of the Covered Goods, or refund of the purchase price, at QuickSilver’s sole discretion.
Licensee and/or customer shall provide written notice to Licensor of the reason for rejecting the Covered Goods.
Inspection: Licensee and/or customer, upon taking possession of the Covered Goods, shall have a reasonable opportunity to inspect the Covered Goods to determine if the Covered Goods conform to the requirements of this Contract.
If QuickSilver elects repair, it will issue a written return merchandise authorization which shall represent QuickSilver’s authorization for the Covered Party to return the Covered Goods to QuickSilver for warranty repair (“Return Merchandise Authorization”).
