Any unintentional acquisition, access or use of PHI by a workforce member or person acting under the authority of a Covered Entity (CE) or Business Associate (BA), if such acquisition, access, or use was made in good faith and within the scope of authority and does not result in further use or disclosure in a manner not permitted under the Privacy Rule.
For the purposes of this definition, a breach is presumed to be a breach unless the Covered Entity (CE ) or Business Associate (BA), as applicable, demonstrates that there is a low probability that the PHI has been compromised based on a four-factor risk assessment as amended in the Final HIPAA Omnibus Rule in §164.402(2).
During the term of this Agreement, Business Associate (“Associate”) may receive from Covered Entity ("CE"), or may receive or create on behalf of CE, certain confidential health or medical information ("Protected Health Information" or "PHI," as further defined below).
Covered Entity (CE) shall have the same meaning given to such term as under the Privacy Rule and Security Rule, including, but not limited to 45 C.F.R. section 160.103.
