In Schedule 8 of the Partnership Agreement, a key decision is defined as a decision in relation to the exercise of Council Functions which is likely to: result in incurring additional expenditure or making of savings which are more than £250,000 result in an existing service being reduced by more than 10% or may cease altogether affect a service which is currently provided in-house which may be outsourced or vice versa and other criteria stated within schedule 8 of Partnership Agreement.
For the purposes of this Schedule 2 (CCG Functions), Schedule 3 (Council Functions) and Schedule 4 (Excluded Functions), reference to legislation and provisions within such legislation mirrors the references contained in the Regulations as at the Commencement Date, and shall be deemed to include any and all replacement and amending legislation and provisions as may come into force from time to time whether prior to or following the Commencement Date.
For the purposes of the implementation of the Partnership Arrangements, the CCGs hereby delegate the exercise of the NHS Functions to the Council to exercise alongside the Council Functions and act as lead commissioner of the Services.
The Council Functions will be subject to the Council’s obligations for Best Value.
