  • If the Contractor does not obtain consent in writing from COTA prior to assignment of this contract, any such assignment shall be considered void.

  • COTA will not reimburse prime contractors for work performed by subcontractors unless and until the prime contractor ensures that the subcontractors are promptly paid for the work they have performed.

  • The failure of COTA to insist, in one or more instances, upon the performance of any term of this Contract is not a waiver of COTA’s right to future performance of such term, and the Contractor’s obligation for future performance of such term shall continue in effect.
