Costs Award definition

Costs Award means the award of costs which the Ontario Court ordered to be paid by the Plaintiffs to the Selling Defendants by order made February 21, 2017 in the Ontario Action.

Examples of Costs Award in a sentence

  • If the Court denies, in whole or part, Class Counsel’s Application for an Attorneys’ Fees and Costs Award, the remainder of the terms of this Agreement shall remain in effect.

  • Court approval of the Attorneys’ Fees and Costs Award will not be a condition of the Settlement.

  • If the Court denies, in whole or part, Class Counsel’s Application for Attorneys’ Fees and Costs Award, the remainder of the terms of this Agreement shall remain in effect.

  • Within five (5) business days after the Maximum Settlement Amount is deposited into the QSF, the Settlement Administrator shall issue and mail checks for the Service Award, the Settlement Administration Expenses Award, and the Attorney’s Fees and Costs Award to the respective recipients thereof.

  • Subject to approval of the Settlement by the Superior Court, the Company agrees to deposit the Maximum Settlement Amount into a Qualified Settlement Fund (“QSF”) set up by the Settlement Administrator for purposes of processing the Settlement and paying the Service Awards, the Settlement Administration Expenses Award, the Attorneys’ Fees and Costs Award, and the Settlement Awards.

  • Any order or proceedings relating to the applications for the Attorneys’ Fees, Expenses, and Costs Award and the Incentive Award, or any appeal from any order relating thereto or reversal or modification thereof, will not operate to terminate or cancel this Agreement or affect or delay the finality of Final Order and Judgment approving the Settlement Agreement and the Settlement.

  • Upon the full payment of the Common Benefit Fee and Costs Award, HESI shall be immediately and fully discharged from any and all further liability or obligation whatsoever with respect to any and all common benefit and/or Rule 23(h) attorneys’ fees, costs and expenses incurred by or on behalf of the DHEPDS Class or the New Class, or any member thereof, in respect of, or relating in any way to, directly or indirectly, any and all Released Claims.
