Cost Pools definition

Cost Pools shall have the meaning set forth in Section 4.3, below.
Cost Pools shall be: (i) the Apartment Portion, (ii) the Two Rincon Office Portion, (iii) the Two Rincon Retail Portion (iv) the ▇▇▇ ▇incon Office Portion, (v) the O▇▇ ▇▇▇con Retail Portion, and (vi) ▇▇▇ ▇▇-site Parking Area. To the ex▇▇▇▇ ▇perating or tax costs are directly and solely attributable to a specific Cost Pool, such operating or tax costs will be charged directly to such Cost Pool based upon an equitable comparison of relative square footage or as otherwise determined by Landlord, in Landlord's sole discretion. To the extent operating or tax costs are attributable and allocable to two or more Cost Pools, such Operating Expense will be prorated on an equitable basis amongst such Cost Pools, and therefore, only operating or tax costs attributable to the One Rincon Office Portion shall be part of Operating Expenses or Tax Ex▇▇▇▇▇▇. To the extent operating or tax costs are common to all Cost Pools, such Operating Expense will be allocated among the Cost Pools in accordance with the following percentages: (a) Apartment Portion - 26.492%, (b) Two Rincon Office Portion - 28.176%, (c) Two Rincon Retail Portion - 3.▇▇▇%, (d) One Rincon Office Portion - 30.▇▇▇%, (e) One Rincon Retail Portion - 8.▇▇▇%, and (f) On-site Parking Area - 2.50▇%.
Cost Pools shall be: (i) the Apartment Portion, (ii) the Two ▇▇▇▇▇▇ Office Portion, (iii) the Two ▇▇▇▇▇▇ Retail Portion (iv) the One ▇▇▇▇▇▇ Office Portion, and (v) the One ▇▇▇▇▇▇ Retail Portion. To the extent operating or tax costs are directly and solely attributable to a specific Cost Pool, such operating or tax costs will be charged directly to such Cost Pool. To the extent operating or tax costs are attributable and allocable to two or more Cost Pools, such Operating Expense will be prorated on a square footage basis amongst such Cost Pools, and therefore, only operating or tax costs attributable to the Two ▇▇▇▇▇▇ Office Portion shall be part of Operating Expenses or Tax Expenses. To the extent operating or tax costs are common to all Cost Pools, such Operating Expense will be allocated among the Cost Pools in accordance with the following percentages: (a) Apartment Portion – 30.52%, (b) Two ▇▇▇▇▇▇ Office Portion – 27.78%, (c) Two ▇▇▇▇▇▇ Retail Portion – 3.05%, (d) One ▇▇▇▇▇▇ Office Portion – 32.54%, and (e) One ▇▇▇▇▇▇ Retail Portion – 6.11%. The allocation of operating and tax costs between Cost Pools shall be made on an equitable and reasonable basis and in a manner consistent between the Base Year and any subsequent Expense Year.

Examples of Cost Pools in a sentence

  • Such Cost Pools may include, but shall not be limited to, the office space tenants of a building of the Project or of the Project, and the retail space tenants of a building of the Project or of the Project.

  • Landlord shall have the right, from time to time, to equitably allocate some or all of the Direct Expenses for the Project among different portions or occupants of the Project (the "Cost Pools"), in Landlord's reasonable discretion.

  • Such Cost Pools may, for example, include, but shall not be limited to, the office space tenants of the Building and the retail space tenants.

  • Landlord shall have the right, from time to time, to equitably allocate some or all of the Direct Expenses for the Project among different portions or occupants of the Project (the "Cost Pools"), in Landlord's discretion.

  • Such Cost Pools may also include an allocation of certain Operating Expenses within or under covenants, conditions and restrictions affecting the Project.

  • Such Cost Pools shall include, but shall not be limited to, the office space tenants of a particular office building and the retail space tenants of a particular building or of the Project.

  • Accordingly, Direct Expenses shall be charged to the Retail Space and the office space by virtue of the creation of Cost Pools.
