  • During the applicable Warranty Period for Network Equipment, Copper Mountain warrants to Customer that the Network Equipment shall be free from material defects in workmanship and materials under normal use and service and shall operate substantially in accordance with the specifications set forth in the documentation provided to Customer.

  • If Copper Mountain does not request Customer to return Defective Network Equipment to Copper Mountain, Copper Mountain shall repair or replace such Network Equipment, in accordance with Section 7.3.

  • In accordance with and subject to the terms and conditions of this Agreement, Customer hereby orders and agrees to purchase from Copper Mountain, and Copper Mountain hereby accepts and agrees to sell to Customer, the Equipment.

  • Copper Mountain may cancel or postpone any Purchase Order placed with, and accepted by, Copper Mountain if Customer fails to make any payment when due as provided in Section 3.2 or is in default as set forth in Section 12.2.

  • Copper Loop is a stand-alone local loop comprised entirely of copper wire or cable. Copper Loops include two-wire and four-wire analog voice-grade copper Loops, digital copper Loops (e.g., DS0s and integrated services digital network lines), as well as two-wire and four-wire copper Loops conditioned to transmit the digital signals needed to provide digital subscriber line services, regardless of whether the copper Loops are in service or held as spares.
