Contractual Rent definition

Contractual Rent means the annual rent passing under the relevant Compromised Lease immediately prior to the CreditorsMeeting Date including, where there is a Turnover Rent, the base or other minimum level of rent payable notwithstanding turnover.

  • For the avoidance of doubt, nothing in this provision, nor in this Settlement Agreement, shall prevent ▇▇▇▇▇▇ ▇▇▇▇▇▇ from entering into a lease agreement with a tenant that requires a tenant to pay, over the lease term, less than the maximum amount that ▇▇▇▇▇▇ ▇▇▇▇▇▇ may, under the Contractual Rent Increase Limitation, seek as the maximum rent for the tenant.

  • Once the new Contractual Rent has been adjusted, such Contractual Rent will remain unchanged during such Rent Reset Term.

  • The Contractual Rent will be the amount set out on the Information Form and will remain the same for one (1) year (the “Rent Reset Term”).

  • The Owner-Resident will be informed of the new Contractual Rent at least sixty (60) days prior to the end of each Rent Reset Term, as applicable.

  • Although increases to the Occupancy Cost would not affect the Contractual Rent during the Rent Reset Term, they would decrease the Rent Equivalent.

  • The Parent shall not permit (i) the ratio of EBITDA plus Contractual Rent Expense minus Capital Expenditures (excluding Acquisitions) to Fixed Charges to be less than 1.30 to 1.00, and (ii) the ratio of EBIDTA plus Contractual Rent Expense to Fixed Charges to be less than 1.65 to 1.00, determined in each case on the last day of each fiscal quarterly period for the four fiscal quarters ending on such date.

  • The Revolving Borrower shall not permit the ratio of (i) an amount equal to (A) the sum of EBITDA plus Contractual Rent Expense minus (B) Capital Expenditures (excluding Acquisitions) to (ii) Fixed Charges to be less than 1.30 to 1.00, determined in each case on the last day of each Fiscal Quarter for the period of four Fiscal Quarters ending on such day.

Related to Contractual Rent

  • Additional Rent means all amounts payable by the Tenant under this Lease except Base Rent, whether or not specifically designated as Additional Rent elsewhere in this Lease;

  • Rent means “eligible rent” to which regulation 12 of the Housing Benefit (Persons who have attained the qualifying age for state pension credit) Regulations 2006 refer, less any deductions in respect of non-dependants which fall to be made under paragraph 30 (non-dependant deductions);

  • Renewal Rent for the Aircraft means the rent payable therefor in respect of a Renewal Lease Term determined pursuant to Section 17.2.2 of the Lease.

  • Monthly Rent means the monthly installment of Minimum Annual Rent plus the monthly installment of estimated Annual Operating Expenses payable by Tenant under this Lease.

  • Basic Rent means the rent payable for the Aircraft pursuant to Section 3.2.1(a) of the Lease.
