Contractor Non-Performance has the meaning given in Clause 13.1;

Without prejudice to Clause 40.19, the Contractor shall bear both Parties’ costs and expenses in respect of the agreement and implementation of a Rectification Plan, except to the extent that the Contractor can demonstrate that the Contractor Non-Performance would not have occurred but for a DCC Cause in which case DCC shall be liable for both Parties’ costs and expenses in accordance with Schedule 22 of this Agreement.
