If NYSERDA first purchases Tier 4 RECs pursuant to the Purchase Agreements prior to the Inside Date, the Contract Delivery Term shall nonetheless not commence until the Inside Date.
This Agreement shall be effective as of the Effective Date and shall terminate on the sooner to occur of (i) the expiration of the Contract Delivery Term, and (ii) the effective date of termination in accordance with applicable provisions of this Agreement.
