Contract Cap definition

Contract Cap means Two Million Dollars ($2,000,000) for an Eligible Loan which is not secured by Liquid Collateral, and Four Million Dollars ($4,000,000) for an Eligible Loan which is partially or fully secured by Liquid Collateral.

  • If a Party receives an amount of damages under this Agreement which, when aggregated with any amounts it has received under the User’s Access Contract, results in the Access Contract Cap being exceeded it must refund the excess amount received over the Access Contract Cap to the other Party.

  • Payments of charges for services, GST and interest are not taken into account in determining whether the Access Contract Cap has been exceeded.

  • Payments of charges for Metering Services, GST and interest are not taken into account in determining whether the Access Contract Cap has been exceeded.

  • This Agreement is not valid for amounts that exceed the Contract Cap unless amended in a writing signed by an authorized representative of both parties.

  • The County shall pay for any passes issued to Eligible County Clients pursuant to Section 4(i) of this Agreement, by PSTA, prior to the expiration or termination of this Agreement, however terminated, up to the Contract Cap.

  • This Agreement shall terminate on September 30, 2017, or immediately when PSTA has invoiced the County for a total of Ninety-five Thousand U.S. Dollars ($95,000) (the "Contract Cap"), whichever occurs first.

  • Services performed beyond the Contract Cap shall be paid only with the prior approval of Tribe in a written modification to this Agreement.

  • The County shall not reimburse PSTA for any amount in excess of the Contract Cap without prior notice and approval pursuant to paragraph 6(iii) above.

  • The County shall have ten (10) days from the date of such notice to provide written notice to PSTA that the County wishes to extend the Agreement, at which time the County may either waive the Contract Cap or the Parties may agree to a new, increased Contract Cap.

Related to Contract Cap

  • Contract carrier means any person who, under special and individual contracts or agreements, and

  • Contract Capacity has the meaning set forth in Section 3.1(f).

  • EPC Contractor means Seller’s engineering, procurement and construction contractor or such Person performing those functions.

  • Contract Cost means the Contract Sum plus Price Variation. This cost shall be included in the letter of acceptance.

  • Contract Charges means charges that accrue during a given month as defined in Article III. “Contract Term” is defined in Article IV.
