The Landlord hereby represents and warrants that the Building and the Lands are properly zoned for the Contemplated Use.

This Contract shall be amended from time to time in order to add to the definition of Real Property, as set forth in Exhibit B, any other parcel of Real Property (outside of the Initial Resorts) which Seller or Owner currently owns or which may be acquired by Seller or Owner at any time during the term of this Contract, from which a mutually agreed upon portion may be segregated and conveyed to Purchaser, for the purposes consistent with the Purchaser's Contemplated Use as defined herein.
Buyer shall have the right to review Seller's title to the Property and to object to any exception to title (other than those reflected on the Title Schedule) that renders title unmarketable or unusable for Buyer's Contemplated Use and (a) is reflected in the Title Report and disclosed to Seller by Buyer within ten (10) days after its receipt of the Title Report or (b) is otherwise disclosed to Seller by Buyer within ten (10) days after Buyer's first discovering same.
Any use in this Contract of the phrases "Purchaser's Contemplated Use", "contemplated use of the Property," or similar phrases shall mean Purchaser's development, use and enjoyment of the Property as described in Section 15.1.
To use the Premises for the Contemplated Use and all other uses ancillary thereto in accordance with all applicable Laws.
