Constructive Change definition

Constructive Change means an act or omission that, although not identified by a “change order,” does in fact cause a change in the contract work.
Constructive Change means an act or omission by Recipient or Subrecipient, which in fact causes a change in the contract work.
Constructive Change shall have the meaning set forth in Section 7.4.

Examples of Constructive Change in a sentence

  • A Constructive Change Directive shall be used in the absence of total agreement on the terms of a Change Order.

  • Constructive Change Directive: A written order signed by JEG directing a change in the Work prior to an agreement on the adjusted Contract Amount or time adjustment to the Subcontract, if any.

  • A Constructive Change Directive is a written order signed by JEG directing a change in the Work prior to an agreement on price or time adjustment to the Purchase Order, if any.

  • JEG, without invalidating the Subcontract, may order extra work or make changes in the Work by altering, adding to, or deducting from, the Work by Change Order, Constructive Change Directive, or order for a minor change in the Work.

  • Any modification to this Agreement shall only be effective if it is reduced to writing, and duly executed by both parties, except a Field Directive or Constructive Change Directive shall be effective after approval and execution by Director or designee.

Constructive Change means, with respect to an AACS Authorized Digital Output only, a pattern or repeated instances of failure to enforce compliance with specifications, license terms and/or compliance rules in effect at the time of AACS LA’s approval of the AACS Authorized Digital Output, which leads either to a significant number of implementers not complying or to a smaller number of implementers, including a single implementer, repeatedly breaching (i.e., multiple products/versions), in either case with repeated non-enforcement, and in either case thereby causing a constructive change to such specifications, license terms and/or compliance rules.
