For each such Construction Work Package Request, the Contractor will submit a firm fixed price proposal to the Contracting Officer in response to and in compliance with that request.
If the quantity of a unit-price item, if any, in a Task Order for a Construction Work Package is an estimated quantity and the actual quantity of the unit-price item varies more than 15 percent above or below the estimated quantity, an equitable adjustment in the Task Order Price for that Construction Work Package shall be made upon demand of either party.
The plan shall include the procedures for complying with the requirements of the Contract Documents, and provide specifics for each Construction Work Package.
For each Construction Work Package, the Task Order Price will be comprised of the following three components: the CMR Construction Services Approved Direct Cost; the CMR Construction Services General Conditions Fee; and, the CMR Construction Services Fee.
Provide an itemized proposal of the direct costs to perform the Work required by the Construction Work Package, as well as the supporting documentation for that proposal, including: manufacturer and supply contract proposals and agreements; and bid tabs addressing all bids and proposals received.
Before taking possession of and/or using any completed or partially completed portion of a Construction Work Package, the Contracting Officer shall furnish the Contractor a list of items remaining to be performed or corrected by the Contractor for that portion of the Construction Work Package.
The Scheduled Substantial Completion Date for each Construction Work Package is stated in the Task Order for that Construction Work Package.
The Contractor shall propose and provide teams of key personnel for each Construction Work Package, and, except as otherwise required by the Program Specifications, the Contractor shall determine the composition of those teams.
Nothing in this Section 16.14.1 shall render the Contractor responsible for normal wear and tear or damage caused by the Authority while it occupies or uses a portion of a Construction Work Package.
The Contracting Officer may issue the Contractor a Construction Work Package Request for a portion of the Program for which the Contractor provided Pre- Construction Services based on its satisfactory performance of (1) those Pre-Construction Services, (2) completed Construction Work Packages, and (3) on-going Construction Work Packages.
