Construction Staff means the Project executive, project managers and superintendents assigned to the project, administrative and professional staff performing scheduling, cost estimating and accounting services assigned on a full-time basis to the Project site; Fringe Benefits associated with construction staff; Payroll taxes and payroll insurance associated with construction staff; Staff costs associated with obtaining permits and approvals; Out-of-house consultants; Field office for the Construction Manager including but not limited to: (i) trailer purchase and/or rent; (ii) field office installation, relocation and removal; (iii) utility connections and charges during the Construction Phase; (iv) furniture; and (v) office supplies; Office equipment including but not limited to: (i) computer hardware and software; (ii) fax machines; (iii) copying machines; (iv) telephone installation, system and use charges; and (v) job radios; Local delivery and overnight delivery costs; and First aid facility. Costs Not to Be Reimbursed. All costs not specifically listed in Section 9.1 as being within the Cost of the Work are excluded from the Cost of the Work and shall not be reimbursable. In particular, but without limitation, the Cost of the Work does not include any of the following: Any personnel or labor costs other than those provided for in Section 9.1.2(a) or 9.2.1; Fees for any permits or licenses the Construction Manager requires to conduct its general business operations; Capital expenses and interest on capital employed for the Work; Direct or indirect costs of any kind, except those expressly included in Section 9.1.; Sales or use taxes, unless the Construction Manager establishes that applicable law required payment of such taxes; Costs due to the errors or omissions of the Construction Manager or its Subcontractors or suppliers at all tiers, negligent or otherwise; Costs dues to breach of the Agreement by the Construction Manager or its Subcontractors or material suppliers at all tiers, including, without limitation, costs arising from defective or damaged Work or its correction, disposal of materials or equipment erroneously supplied, and repairs to property damaged by the Construction Manager or its Subcontractors or material suppliers at all tiers; Any costs incurred in performing work of any kind before Notice to Proceed, unless specifically authorized by a duly authorized Contracting Officer of the Department in advance and in writing; The cost of home or regional of...
