If required under the Construction Approval Process in connection with any Parking Facilities Improvements or Alterations constructed or installed by Operator, Operator shall furnish, at its sole cost and expense (except as otherwise expressly provided in this Agreement), a payment bond as prescribed by the City Attorney in the principal sum (i.e., 100%) of the amount of the construction, alteration, repair or improvement work in excess of $25,000 proposed by Operator.
Operator shall not make any improvements or alterations to any of the Facilities (“Alterations”) without the prior written approval of the Chief Executive Officer and without first complying with City’s Construction Approval Process and the Design and Construction Handbook.
