Except as expressly provided to the contrary in this Article VI (Construction, Maintenance and Repair), and subject to the State’s obligation to construct the Consolidated Facility Improvements in accordance with the Consolidated Facility Plans, the State makes no warranty, either express or implied, as to the condition of the Premises or that the Premises shall be suitable for RAC’s purposes or needs.
In the event that RAC fails to participate in a joint inspection of the Premises within the aforementioned 10-business day period, RAC shall be deemed to have accepted the Consolidated Facility Improvements as completed in accordance with the Consolidated Facility Plans.
If applicable, within ten (10) business days after the State notifies RAC in writing that Consolidated Facility Substantial Completion has occurred, the State and RAC shall conduct a joint inspection of the Premises and shall agree upon a written list of the “punch list” items identifying touch- up work, minor repairs, and incomplete items necessary to complete the Premises in substantial accordance with the Consolidated Facility Plans.
