Connectee shall be required to fully abide by and adhere to the Sewer System Rules and Regulations governing the TCSD System, Attachment 3.
Connectee acknowledges, understands, and agrees that there may be events or circumstances which may require, or result in, the interruption, reduction, or stoppage of wastewater conveyance through the TCSD System.
Connectee specifically acknowledges and agrees to abide by the prohibition against septic dumping and the dumping of any hazardous materials or other unapproved substances into the TCSD System or Town Wastewater Facility through the WGFD System, as provided in Section 4.2 of the Sewer System Rules and Regulations.
As consideration for the license granted by TCSD herein for connection to the TCSD System, Connectee shall pay to TCSD a connection fee in the amount of Six Thousand Six Hundred Dollars ($6,600) (“Connection Fee”) per each equivalent residential unit (“ERU”), as further defined in the TCSD Wastewater Fee Schedule, attached hereto as Attachment 4 and incorporated by this reference.
Each Invoice shall include both the TCSD Usage Fees and the Town Usage Fees charged against the WGFD System and shall be billed to Connectee at cost.
In the event of interruption, disruption, reduction, or stoppage of wastewater conveyance services through the TCSD System resulting from the Town’s operation, management, and administration of the Town Wastewater Facility or its capacity limitations, Connectee may terminate this Agreement as set forth in Section 12 below.
This Agreement may be terminated by TCSD upon Connectee’s failing to provide the emergency or other notices required in Section 2 and after one (1) event request notification upon which such notice is not provided by Connectee.
In addition to the Connection Fee, Connectee shall be required to pay to TCSD a monthly wastewater conveyance usage fee (“Usage Fees”) in accordance with the Fee Schedule set forth in Attachment 4, which such fees may be increased at any time in TCSD’s authority and reasonable discretion, and which shall state and include the current fees charged by the Town for the TCSD System and its connectees (“Town Usage Fees”).

This Agreement may be terminated by Connectee upon thirty (30) days’ notice and opportunity to cure to TCSD if TCSD is in breach or default of any term, provision, requirement, or obligation set forth in this Agreement.
