Configured Software means software which exists and/or has been designed and developed with the intention of being configured to meet the specific requirements.

Configured Software means the software the subject of the Configuration Services as specified in the Contract.

If the time spent on such support exceeds 2 hours in any 1 month period following live implementation of the Configured Software (measured consecutively from the date of live implementation), Data8 shall have the right to charge Customer for further support at Data8’s standard rates or otherwise agreed between the parties.

Data8 shall not be responsible or liable for any downtime or unavailability of the Software, Configured Software or Services, to the extent permitted by law.
The thankQ Solutions are Access Software, as defined in the Framework Agreement unless they are modified by us as part of Consultancy Services for you in which case they shall be Configured Software.

Configured Software means software code changes and additions to Software specifically developed or modified or written by Us for You; Confidential Information means any information, however conveyed or presented that relates to the business, affairs, operations, customers, processes, budgets, pricing policies, product information, strategies, developments, trade secrets, know-how, personnel and suppliers of the disclosing party, together with all information derived by the receiving party from any such information and any other information clearly designated by the party as being confidential to it (whether or not it is marked “confidential information”), or which ought reasonably be considered to be confidential;
