Subject to any provision of this Lease relating to stoppage of services and Landlord’s inability to perform, Landlord shall supply Supplemental Condenser Water to the Premises on a twenty-four (24) hour, 365 day basis.
The Condenser Water Charge shall be paid in twelve (12) equal monthly installments, on the first day of each month during the Term, as additional rent.
On January 1, 2001, and on each January 1 thereafter throughout the Term of the applicable Lease, the Condenser Water Charge will increase by two and one-half (2 1/2%) percent of the Condenser Water Charge in effect on the immediately preceding day.
Tenant shall pay to Landlord, as Additional Rent, the Condenser Water Charge for condenser water supplied by Landlord pursuant to Section 5.1.1, the Overtime HVAC Charge for the Overtime HVAC service provided by Landlord pursuant to Section 5.1.2, and all charges for electricity supplied by Landlord to the Premises, if any (which may include electricity for ventilation and cooling, including reheat coils, fan boxes, compressors and refrigerating units serving the Premises).
Commencing as of the Commencement Date, Tenant shall pay to Landlord an annual charge of $344.35 per ton of Supplemental Condenser Water (the “Annual Condenser Water Charge”), plus sales tax, if applicable, subject to increase as provided for herein.

Tenant shall pay to Landlord, as additional rent, an hourly charge (the "Condenser Water Charge") for furnishing condenser water to the Supplementary System.
In the event that Tenant shall fail to provide Landlord with Tenant’s Condenser Water Notice in a timely manner or in the event that Tenant’s Condenser Water Notice shall request, or Tenant shall use, less than the full five (5) tons of Condenser Water referred to above, then Tenant’s access to Condenser Water shall be limited to that lesser amount so requested and used by Tenant, and Tenant’s access to any additional Condenser Water shall be subject to availability on a first-come/first-served basis.
Tenant shall pay to Landlord as Additional Rent under the Lease the following charges (plus sales tax, if applicable) in consideration of Landlord’s agreement to make available to Tenant Supplemental Condenser Water hereunder, commencing as of the date upon the Commencement Date, an annual charge of $900.00 per ton of Supplemental Condenser Water per annum (the “Annual Condenser Water Charge”), subject to increase as provided for herein.
Landlord shall read the elapsed time meter for the Supplementary System (which meter shall measure only the time of operation of the compressor(s) of the Supplementary System) from time to time and ▇▇▇▇ Tenant an amount equal to the product obtained by multiplying (i) the then-applicable Condenser Water Charge, by (ii) the number of hours of operation of the compressor(s) of the Supplementary System since the prior reading of such meter.
