Concealed Works definition

Concealed Works means the Works performed and concealed by subsequent Works and structures, the quality and precision whereof will become unidentifiable after the performance of subsequent construction Works and installation of structures, and the actual performance whereof needs to be confirmed by the Construction Supervision of the Customer. “Term of the Agreement” means the period from the date of Agreement’s coming into force till the complete performance by the Parties of the obligations hereunder, which include the obligations of the Parties during the warrantee period. “Construction Site” means a land plot transferred to the Contractor for the period of Works performance till the Facility commissioning, and suitable for the Works performance hereunder. “Construction Supervision of the Customer” means a set of arrangements conducted by the Customer’s Representatives in the course of construction, reconstruction, capital repair of capital construction facilities, in order to ensure the compliance of the works performed with the requirements of design documentation, technical regulations, results of engineering surveys, requirements of a development plan for the land plot. “Work Specification” means appendix No 2 hereto which contains types of works, structure of documentation passed to the Contractor, and special terms and requirements which the Contractor needs to take into account when performing the Works. “Works Milestone” means a portion of Works which may be inspected and accepted by the Customer, and provided for in the Agreement, Design Documentation and stipulated in the Works Schedule (Appendix No 3 hereto). The definitions provided above may be used both in singular and plural form.

Examples of Concealed Works in a sentence

  • The Contractor shall rework all the Concealed Works or any other Works and provide them to the Customer for Acceptance pursuant to the Inconsistencies Elimination Certificate.

  • In case any inconsistencies are revealed in Concealed Works performed, which are subject to covering-up, or in any other Works, the Customer shall issue the relevant instructions, which are mandatory for the Contractor.

  • On the date any Loan is made or any Letter of Credit is issued hereunder, each Security Document will constitute a valid and perfected lien of first priority in and to all the Collateral and will be enforceable against all third parties in all jurisdictions as security for all obligations which such Security Document purports to secure.
