Compliance Issues definition

Compliance Issues means failures to comply with the terms or provisions of Dispositions, the EPEA Registrations or the Regulatory Legislation;
Compliance Issues. Litigation Issues:
Compliance Issues means one or more of the following: (i) the State determines based upon a good-faith analysis, which shall be shared in writing with CHA and the Hospitals, that the provision of Medicaid payments to Hospitals or the Second Hospital User Fee no longer complies with Federal Requirements, including, but not limited to, when compliance requires a change in the base year or tax rate of the Second Hospital User Fee or to the supplemental pools and distribution criteria, (ii) CMS, a court, or other authorized federal agency has determined in writing that one or more provisions of the legislation adopted by the State in Exhibit 4 or one or more of the required actions to be taken by the State set forth in the Agreement do not comply with Federal Requirements, (iii) CMS, a court, or other authorized federal agency has nullified or rescinded in writing one or more of the CMS Approvals, or (iv) the State is required to make payments above the UPL using state-only funds as set forth in paragraph 54 of the Agreement.
