Completed Facility definition

Completed Facility means an Eligible Project which has met the conditions set forth in Section 4.3 Conditions Under Which an Eligible Project is a Completed Facility of this Agreement.
Completed Facility shall have the meaning set forth in Recital A.
Completed Facility means an Eligible Project which has met the conditions set forth in Section 2.06 of the Construction Loan Agreement.

Examples of Completed Facility in a sentence

  • The first resident of a Completed Facility shall take occupancy within sixty (60) days of the issuance of the occupancy permit for such Facility.

  • Any proceeds from a sale of Assets other than any such Completed Facility or Completed Equipment Group shall be distributed pursuant to Section 5.3(g)(i) above.

  • The Administrative Agent shall have received true copies of the Prime Construction Contract and the Architect's Agreement relating to the construction of such Facility, which agreements (i), if such Facility is not a Completed Facility, shall be (A) in form and substance acceptable to the Agents, and (B) in full force and effect, and (ii), in any event, shall be free from material default by the parties thereto and the applicable Lessee shall so certify to the Agents.

  • Upon completion of the Work, within 30 days from the date of signing of the Completed Facility Acceptance Certificate (form КС-11), the Contractor shall remove from the Construction Site all its own equipment and construction machinery, surplus materials, etc., dismantle temporary buildings and structures erected by it and leave the Facility and the Construction Site in the condition corresponding to the environmental requirements and sanitary norms.

  • The Contractor shall ensure protection of the Facility under construction, and materials, equipment, construction equipment and consumables located at the construction site, during the Work Performance under the Contract until the Facility is accepted under the Completed Facility Acceptance Certificate.

  • Any Eligible Project to be constructed or under construction must qualify as a Pool A Project when it is added to the Borrowing Base; however, any Completed Facility or Acquisition Project which is completed may be added to the Borrowing Base as either a Pool A Project, a Pool B Project or a Pool C Project.

  • The Contractor undertakes to provide to the Recipient all documentation required for operation and warranty maintenance of the Facility within Fifteen (15) calendar days from the signature date of the Completed Facility Acceptance Act.

  • Unless such Facility is a Completed Facility (in which Participation Agreement case this condition shall not apply), all building permits required by any Governmental Authority in connection with the then current phase of construction for which the applicable Construction Advance is being made shall have been obtained.

  • The Borrowers may request and the Requisite Lenders (as defined in the Agency Agreement) may in their sole discretion agree to include as an Eligible Project a Completed Facility which a Borrower has acquired which meets the conditions precedent to including a completed Facility as an Eligible Project.


More Definitions of Completed Facility

Completed Facility means a manufacturing facility that is operating in accordance with requirements in the Preliminary Certificate and performance agreement between the Department and the Applicant for which all costs have been paid or committed by a binding contract or agreement.
Completed Facility means a Facility for which the Facility Completion Date has occurred.
Completed Facility means a Facility that shall have been fully constructed, completed and operational prior to becoming Leased Property and for which only one Construction Advance shall be made. In determining whether a Facility has been "fully constructed, completed and operational," the conditions set forth in Section 3.7 of the Participation Agreement shall apply, mutatis mutandis.

  • Project Facility means facility being one or more of the following facilities as specified in the Special Conditions of Contract, being developed in accordance with the Project and the Detailed Project Implementation Report and includes all its buildings, equipment, facilities, software and systems and includes without limitation, where the circumstances so require, any expansion thereof from time to time and may include any new location to be separately mentioned in the Special Conditions of Contract.
