Examples of Competitive Terms in a sentence
If the Restricted Party determines that the Company is not offering to provide Competitive Terms to the Restricted Party or any Restricted Subsidiary, the Restricted Party shall notify the Company and the parties shall negotiate in good faith for thirty (30) days to attempt to agree to Competitive Terms.
If, after such negotiation period, the Company has not agreed to provide such products or services to the Restricted Party and the Restricted Subsidiaries on Competitive Terms, the Restricted Party and Restricted Subsidiaries may utilize an alternative provider with respect to such products or services on terms no less favorable than those being offered by the Company.
Provided that Supplier is able to supply the Company with Products on Market Competitive Terms, Supplier shall sell and Company agrees to purchase Company’s requirements for the Products (or products that reasonably substitute for the Products) from Supplier.
In the event that Buyer desires to retain a third party to manufacture new products not covered by this Agreement during the Term other than OEM products that are designed and developed by the OEM for Buyer (“New Products”), Buyer shall in good faith provide Supplier with the first option to enter into an agreement to manufacture such New Products on Market Standard Competitive Terms.
Owner and Manager further agree that Manager may permit an Affiliate of Manager to utilize a portion of the Site or Hotel to install a desk or kiosk to market and/or sell interests in a time-share facility or facilities developed and/or marketed and sold by such Affiliate, provided the economic terms of such arrangement satisfy the Competitive Terms Standard, and the location of the desk or kiosk at the Hotel shall be subject to Owner’s approval.
