Common Areas and Common Elements definition

Common Areas and Common Elements includes all property and structures not exclusively owned by a Unit Owner and which are situated in neither a Limited Common Area nor an Exclusive Limited Common Area, to include, but not limited to, open space, recreational facilities, clubhouse, pool, ▇▇▇▇▇▇ ▇▇▇▇▇▇, ▇▇▇▇▇▇▇, entrances, bridges and the Disposal System. All Unit Owners shall have an equal, undivided interest in the Common Area and Common Elements of the Development. These Areas shall be controlled and maintained by the Homeowners’ Association and the cost of the same shall be assessed to all Unit owners within the Development.

Examples of Common Areas and Common Elements in a sentence

  • It is specifically understood that certain Common Areas and Common Elements (excluding the Exclusive Limited Common Areas and Limited Common Areas) are subject to easements in common with other parties as defined in this Declaration and the rights of other parties set forth and described in this Declaration to the joint and mutual use of such properties.

  • Seller is the owner of that certain condominium property identified as Land Unit 1 in the Declaration of Condominium of the ▇▇▇▇▇ Condominium, as amended (the “Condominium Declaration”), together with the appurtenant Limited Common Elements allocated to Land ▇▇▇▇ ▇ and together with the Common Areas and Common Elements described in said Declaration of Condominium (the “Condominium”), which Land ▇▇▇▇ ▇ is located in Smithfield, Rhode Island, as more particularly described on Schedule A (the “Land”).

  • Declarant and the respective Builder(s) reserve the right for themselves and others designated to inspect, monitor, test, redesign and correct any Unit, improvement or condition which may exist on any portion of the Development Property, including the Lots, Units, Common Areas and Common Elements, and a perpetual easement of access through the Development Property for such purposes.

  • Any amenities (e.g. parks, playground equipment, and/or walking trails), Common Areas, and Common Elements provided by the Association or Townhouse Association or erected within the Development Property, if any, shall be used at the risk of the user, and the Association and Townhouse Association shall not be held liable to any person for any claim, damage, or injury occurring thereon or related to use thereof.
