Collection Materials means materials used under the standard operation procedures for blood collection, handling, and processing at each of the Plasma Donor Center Divestiture Facilities (e.g., plasma collection tubes).

Collection Materials means all Solid Waste and Approved Recyclable Materials generated, produced or accumulated by Customers, as applicable, excluding certain materials excluded under the Agreements.

• Subject to the limitations set forth in Section 10 (Limitation of Liability), MSS agrees to defend (or settle) and indemnify Representative against any third party claims against Representative for loss, damage, liability or expense (including but not limited to reasonable attorneys' fees) arising out of any defect or alleged defect in the Sample Collection Materials or the processing of PST Tests.

• Representative may also have a stock of Sample Collection Materials for sampling activities and point of sale opportunities.

• Representative will be responsible for promptly shipping Sample Collection Materials to Dental Providers who have placed orders.

• City grants to Contractor the exclusive right to collect, haul, and dispose of the Collection Materials within City for the period commencing upon the operational date of this Franchise, which is July 1, 2023, and continuing to and including December 31, 2033 (“Initial Term”).

• Representative shall purchase Sample Collection Materials from MSS.
