  • In addition, if an Employee initially waived coverage under this Contract for the Employee's spouse or eligible Dependent children because the spouse and/or Dependent children had coverage under a Consolidated Omnibus Budget Reconciliation Act (COBRA) continuation provision and the Employee requests coverage for the spouse and/or Dependent children under this Contract within 30 days of the date the COBRA continuation ended, We will not consider the spouse and/or Dependent children to be Late Enrollees.

  • If an Employee initially waived coverage under this Contract because he or she had coverage under a Consolidated Omnibus Budget Reconciliation Act (COBRA) continuation provision and the Employee requests coverage under this Contract within 30 days of the date the COBRA continuation ended, We will not consider the Employee to be a Late Enrollee.

  • HMO shall provide the certification (i) at the time a Member ceases to be covered under the plan or otherwise becomes covered under a COBRA continuation provision, (ii) in the case of a Member becoming covered under a COBRA continuation provision, at the time the Member ceases to be covered under the COBRA continuation provision, and (iii) on the request on behalf of a Member made not later than 24 months after the date of cessation of the coverage described in (i) or (ii), whichever is later.

  • The certification under clause (i) may be provided to the extent practicable at a time consistent with notice required under any applicable COBRA continuation provision.
