CMC Documents definition

CMC Documents means the documents identified in Section 1.3 of the CMA. “Code” has the meaning set forth in ITP Section 1.6.4.
CMC Documents means the documents listed in this Section 1.3. The CMC Documents form this “Capital Maintenance Contract” for the performance of the Maintenance Services.
CMC Documents means the documents identified in Section 1.3 of this CMA. Code has the meaning set forth in Recital A to this CMA. [Comparable Limited Access Highways] [include definition if Non-Discriminatory Change provisions are utilized] means highways that are substantially similar to the Project and associated facilities including frontage roads, as applicable. For purposes of this definition, determination of what highways are substantially similar to the Project shall be based on any one or more of similar age, design, engineering, construction, topographical features, operating systems and features, or other features or situations, and/or based on a geographical area in which highways have been or are susceptible to being affected by a common event (such as but not limited to flood or tornado). The presence or absence of tolling and tolling facilities shall not be a factor in determining whether a highway is substantially similar to the Project. Contract Documents has the meaning set forth in Section 1.3 of the DBA. DB Contractor or Design-Build Contractor means , a , together with its successors and assigns.

Examples of CMC Documents in a sentence

  • Following receipt and evaluation of Proposals, based on a determination of apparent best value, the Commission may select a Proposer for negotiations, and authorize TxDOT to finalize the DBC Documents and CMC Documents for award and execution.

  • If TxDOT moves forward with the procurement, the final RFP will include a scope of work, draft DBC Documents and CMC Documents and the objective methodology for determining the overall best value Proposal.

  • Therefore, the procurement documents, including the DBC Documents and CMC Documents, must conform to requirements of applicable federal law, regulations and policies.

  • But that does not change the fact that the state is expressly permitted to engage in rational line-drawing in its provision of PCS cov- erage.

  • At all points in performance of the Maintenance Services at which specific approvals by TxDOT are required by the CMC Documents, DB Contractor shall not proceed beyond that point until TxDOT has made such approval or waived its right in writing to inspect or approve.

  • If any work examined by TxDOT is found not to be in conformance with the requirements of the CMC Documents, then uncovering, removing and restoring all work at TxDOT’s direction shall be at DB Contractor’s cost and DB Contractor shall not be entitled to any adjustment to the Maintenance Price or any other relief.

  • The CMC Documents shall be governed by and construed in accordance with the Laws of the State of Texas.

  • DB Contractor’s entitlement to a Change Order for eligible changes is subject to the restrictions and limitations contained in this Section 4.5 and elsewhere in the CMC Documents, and furthermore is subject to DB Contractor’s compliance with all notification and other requirements identified herein.

CMC Documents means the documents identified in Section 1.3 of this CMA. Code has the meaning set forth in Recital A to this CMA. Contract Documents has the meaning set forth in Section 1.3 of the DBA. DB Contractor or Design-Build Contractor means Lone Star Constructors, an unincorporated joint venture consisting of Fluor Heavy Civil, LLC, a Delaware limited liability company and Austin Bridge & Road, LP, a limited partnership formed under the laws of Delaware, together with its successors and assigns.

Related to CMC Documents

  • L/C Documents means, with respect to any Letter of Credit, such Letter of Credit, any amendments thereto, any documents delivered in connection therewith, any application therefor, and any agreements, instruments, guarantees or other documents (whether general in application or applicable only to such Letter of Credit) governing or providing for (i) the rights and obligations of the parties concerned or at risk or (ii) any collateral security for such obligations.

  • RFP Documents means the following documents to be entered into by the parties to the respective agreements in connection with the supply of power:

  • Public Documents As defined in Section 4.02(a) of this Agreement.

  • LC Documents means the Letters of Credit and all applications, agreements and instruments relating to the Letters of Credit.

  • DIP Documents means the DIP ABL Documents and the DIP Term Loan Documents.

  • Program Documents means this Agreement, the Custodial Agreement, any Servicing Agreement, the Pricing Side Letter, any Instruction Letter, the Intercreditor Agreement, the Joint Securities Account Control Agreement, the Joint Account Control Agreement, the Electronic Tracking Agreement, the Collection Account Control Agreement, and any other agreement entered into by the Seller, on the one hand, and Buyer and/or any of its Affiliates or Subsidiaries (or Custodian on its behalf) on the other, in connection herewith or therewith.

  • Formation Documents means, collectively, the Issuer LLC Agreement, the Issuer Certificate of Formation and any other document pursuant to which the Issuer is formed or governed, as each may be amended or supplemented from time to time.

  • Acquisition Documents means the Acquisition Agreement and all other agreements and documents relating to the Acquisition, as the same may be amended, modified and/or supplemented from time to time in accordance with the terms hereof and thereof.

  • Underlying Documents means, together, the Contracts, the Refund Guarantees, the Supervision Agreements and the Management Agreements and “Underlying Document” means any of them.

  • Regulatory Documents means the prospectus, annual report, semi-annual report and any other document required under applicable federal securities law to be delivered by the Trust to Fund shareholders.

  • Debt Financing Documents means the agreements, documents and certificates contemplated by the Debt Financing.

  • Application Documents means collectively: (i) the grant application submitted by Grantee, including all exhibits, schedules, appendices and attachments thereto; (ii) all documents, correspondence and other written materials submitted in respect of such grant application; and (iii) all amendments, modifications or supplements to any of the foregoing approved in writing by City.

  • Material Documents has the meaning set forth in Section 5.23.

  • Equity Documents means collectively the documents evidencing subscription to Equity to the extent of equity component of cost of the Project.

  • Financing Documents means, collectively, this Agreement, the Note, the Security Documents, the Account Control Agreement and any other agreements, documents or certificates delivered pursuant hereto or thereto.

  • Restructuring Documents means, collectively, the documents and agreements (and the exhibits, schedules, annexes and supplements thereto) necessary to implement, or entered into in connection with, this Plan, including, without limitation, the Plan Supplement, the Exhibits, the Plan Schedules, the Amended/New Organizational Documents, the Exit Facility Loan Documents, and the Plan Securities and Documents.

  • Bidding Documents means the set of Bidding Documents that preceded the placement of the Contract of which these GCC form a part, which were sold or issued by the Purchaser to potential Bidders, and in which the specifications, terms and conditions of the proposed procurement were prescribed.

  • Subordinated Documents means the Subordinated Note and any and all other documents, agreements, writings or instruments executed in connection therewith or pursuant thereto, in each case, as in effect on the date hereof and as amended, modified, restated or Refinanced in accordance with the terms hereof.

  • Documents includes any and all instruments, documents, agreements, certificates, indentures, notices and other writings, however evidenced.

  • Buyer Documents has the meaning set forth in Section 5.2.

  • Other Transaction Documents means the Transaction Documents other than this Agreement.

  • Noteholder Documents means (a) the Second Priority Senior Secured Notes Indenture, the Notes, the Noteholder Collateral Documents and (b) any other related document or instrument executed and delivered pursuant to any Noteholder Document described in clause (a) above evidencing or governing any Obligations thereunder.

  • Bond Documents means the Bonds, the Indenture, the Loan Agreement, the Remarketing Agreement, the Remarketing Circular, and all amendments and supplements thereto.

  • REMIC Documents The document or documents creating and governing the administration of a REMIC.

  • Merger Documents means, collectively, this Agreement, the Certificate of Merger, and all other agreements and documents entered into in connection with the Merger and the other transactions contemplated hereby.

  • Disclosure Documents is defined in Section 5.3.
