In the event that the Parties close on less than the ten (10) Sites ("MINIMUM NUMBER OF SITES") at a Subsequent Closing, the Minimum Number of Sites for the immediately following Subsequent Closing shall be increased by the difference between the then Minimum Number of Sites and the actual number of Closing Sites transferred at the Previous Closing and Buyer shall increase the number of Sites included on the Closing List accordingly.
Subject to the satisfaction of the terms and conditions of this Agreement, the Closing for the Sites listed on the Closing List that are to be transferred pursuant to this SECTION 2.5 shall occur as soon as reasonably possible following the final determination of the Closing List but in no event later than ten (10) Business Days following such final determination.

NBD must have received fully executed copies of all documents listed on the Preliminary Closing List (the "Preliminary Closing List") attached to this Agreement as Exhibit 3.8, and Obligors must have satisfied to NBD's satisfaction all issues and matters identified in the Preliminary Closing List.
