In the event the Developer disputes the calculation of the City Development Fee imposed by the City for a specific development on any portion of the Property, the Developer may, prior to the issuance of a construction permit, appeal the calculation of such City Development Fee by submitting a written request for review to the City Representative.
Following the City’s receipt of an IIP Request from Developer, the City shall determine whether amending the IIP is in the best interest of the City and, if an identified Public Improvement is included in the IIP, the City shall provide a credit toward the payment of a City Development Fee equal to the value of such construction, improvement, contribution, or dedication of that Public Improvement by Developer pursuant to Arizona law and in accordance with this Agreement.
