Chronic Service Issue (or Chronic Problem) A Service Delivery related Problem that has occurred numerous times with no known corrective action for the Problem and resulted in a) repeated failures to meet the requirements set forth in the Statements of Work and b) a significant disruption of Service or Service performance to the DIR Customer.
In the event Customer elects not to remediate or replace Chronic Problem Facilities, Mosaic reserves the right to discontinue monitoring Chronic Problem Facilities upon ten (10) days’ prior notice to Customer’s identified Technical Contact / Tier 1 contact for the SD-WAN Service / Chronic Problem Facility in question.

Sprint agrees to provide to Customer an action plan with respect to correction of such Chronic Problem within 15 days of receipt of Customer’s notice.
Any Domestic service for which Sprint fails to meet the guaranteed Network Availability SLA for three consecutive months will be defined as a “Chronic Problem.” Customer must notify Sprint in writing of a Chronic Problem.
If the Chronic Problem has not been corrected within 45 days after Sprint’s receipt of Customer’s notice, Customer may, within 30 days and upon written notice to Sprint, terminate the affected site.
