Goods must be shipped in CHEP or CPC pallets with packing slips attached.
To the extent that the damage has resulted from what CHEP, at its sole discretion, considers to be fair wear and tear, CHEP shall not charge for the repair of the Equipment, unless the parties agree otherwise.
CHEP has the right to refuse to approve (and thereby to process the transaction) any purported transfer or transfer declaration if (i) it is not made in accordance with the CHEP standard operating procedures or (ii) it is reported to CHEP more than 60 (sixty) days after the actual date of transfer.
Any Equipment not returned to CHEP within that period shall be considered lost, and Clause 7 shall apply.
Such transfers are deemed late declaration and CHEP, at its discretion, will only approve the transfer provided (i) the transferee account is valid at the time of late processing, and (ii) the transferor obtained the transferee party’s written consent to accept such late processing of transfer onto the latter’s account.
It is the obligation of the transferor to establish that the transfer of any Equipment is accepted by the transferee, provide all relevant documents, including goods receipt note (“GRN”) to establish and to obtain the approval of CHEP to such transfer.
CHEP shall give the Customer written notice of such amendments, variations and/or alterations, which shall be deemed to have been accepted by and binding on the Customer unless the Customer informs CHEP that it does not accept such amendments, variations and/or alterations by way of written notice within 21 days from the date of receipt of the notice of amendments, variations and/or alterations from CHEP.
The responsibility shall at all times rest with Customer to ensure that any notification of transfer submitted by it to CHEP has posted clean.
CHEP is entitled to refuse or suspend the processing of any transfer transaction if key data or document is missing or appears to be incorrect as set out in this Agreement or CHEP standard operating procedures.
All pallets shall be in good sanitary condition and 48 inches x 40 inches in size, Grocery Manufacturing Association (“GMA”) or equivalent hardwood, four way entry pallets or CHEP pallets.
