CEC Certified definition

CEC Certified means that the CEC has certified that the Facility is an eligible renewable Energy resource in accordance with Public Utilities Code Section 399.12(e) and the guidelines adopted by the CEC, as amended from time to time, and any successor statute.

Examples of CEC Certified in a sentence

  • Buyer shall release such retained amount, which shall not be calculated with interest of any kind, within forty-five (45) days following the receipt of evidence satisfactory to Buyer from Seller that the Facility is CEC Certified.

  • Following the Commercial Operation Date, Seller shall promptly file with the CEC all materials and documents required for the Facility to be CEC Certified in conformance with the CEC Guidebook for Renewables Portfolio Standard Eligibility, as amended from time to time.

  • Buyer may, in its sole discretion and without penalty to Buyer, terminate this Agreement, effective upon notice to Seller if the Facility is not CEC Certified by the date that is six (6) months following the Commercial Operation Date.

  • Promptly, but in no event more than ten (10) days following the Commercial Operation Date, Seller shall file with the CEC all materials and documents required to demonstrate that the Facility is entitled to be CEC Certified.

  • Buyer may, in its sole discretion and without penalty to Buyer, terminate this Agreement, effective upon notice to Seller if Facility is not CEC Certified by the date that is six (6) months after the Commercial Operation Date.

  • Buyer shall release such retained amount, without interest of any kind, within thirty (30) days following Buyer’s receipt from Seller of the CEC certificate confirming that the Facility is CEC Certified, but only to the extent that Buyer is able to apply the RECs generated by the Facility during the Pre-Certification Period towards compliance with Buyer’s obligations under RPS Law.

  • Buyer shall release such retained amount, which shall not be calculated with interest of any kind, within forty five (45) days following the receipt of evidence satisfactory to Buyer from Seller that the Facility is CEC Certified.

  • If Seller asserts that the failure to be CEC Certified was not the result of Seller’s fault or negligence, then Seller will provide to Buyer's reasonable satisfaction evidence reasonably demonstrating the basis for Seller’s assertion.

  • Following the initial Delivery Notice, Seller shall promptly file with the CEC all materials and documents required for the System to be CEC Certified in conformance with the CEC Guidebook for Renewables Portfolio Standard Eligibility, as amended from time to time.

  • Seller shall promptly provide Purchaser with copies of all material submittals to the CEC and other correspondence between Seller and the CEC, including any correspondence evidencing that the System has been CEC Certified.
