Only two orders of signing made the FA “binding”! LCLC and LLCC; and the first was difficult to prove! The first leaves the grenade of uncertainty. Conceptually, the second lawyer could accidentally or even intentionally sign in the wrong order, thereby ensuring “quiet” invalidity (in other room; or across city). A modified version of this nasty trap still exists after 4 January 2010, when the simplified version of s90G became retrospectively operative. That is, each lawyer must give at least fresh oral advice before his/her client signs the latest amended version of a financial agreement. With each minor amendment, fresh oral advice is still necessary before the client signs. How should each lawyer collect evidence that the two fresh advice-signing sequences occurred?
