Examples of CB Funds in a sentence
Subject to the foregoing provisions of this Section 12.17, each of the CB Funds waives the right to require the Purchaser to first proceed against CBB with respect to any dispute, controversy, or claim arising out of or related to this Agreement, and agrees that any such dispute, controversy, or claim may be brought directly against such CB Fund, CBB, or against any one or more of them.
Each of the CB Funds hereby waives all defenses as a surety including notice, and agrees that its obligations under this Section 12.17 shall not be impaired, diminished or discharged by any extension of time granted by the Purchaser, by any course of dealing between the parties, or by any events or circumstances which might operate to discharge a guarantor.
Each of the CB Funds shall remain liable on its obligations hereunder until the expiration of the CB Funds Guaranty Period.
This Agreement has been duly executed and delivered by each CB Fund, and this Section 12.17 constitutes the valid and binding obligation of each of the CB Funds, enforceable in accordance with its terms, except as such enforceability may be limited by the Enforceability Exceptions.
The CB Funds shall be used to reimburse Borrowers and/or to pay, in accordance with the terms and conditions set forth in this Agreement, for the reasonable costs and expenses incurred by Borrowers in completing the tenant improvements under Section 7 of the Fourth Amendment to the CB Lease.
