If a provision of the Act, a Regulation made under the Act, or a decision of a competent authority results in the employee being deemed to be a Full Time or a Part Time employee and, as a result the employee has been paid the Casual Loading during a period when they were deemed not to be a Casual employee, then the overpayment of that Casual Loading may be recovered from any entitlements that arise from the employee being deemed to be a Full Time or a Part Time employee.
The Specifications and Plan are also intended to explain each other, and anything shown on the plan and not stipulated in the Specifications or stipulated in the Specifications and not shown on the Plan shall be deemed and considered as if embodied in both.
