Cash Flow (Trust). This is the autonomous estate that will be established on the Closing Date under the Cash Flow Trust Contract, to guarantee the fulfillment of all obligations of the Borrower derived from the Loan Documents.

Cash Flow (Trust). It is the autonomous estate constituted under the Cash Flow Trust Contract, to secure the performance of all the Borrower’s obligations arising from the First Loan Contract, and that will be amended so that it also secures the performance of all the Borrower’s obligations arising from this Contract and from all the Loan Documents.

Examples of Cash Flow (Trust) in a sentence

  • The Cash Flow Trust Agreement, Asset Trust Agreement and Repayment Trust Agreement create, or upon the execution of the Effectiveness Statements will create, an estate separate (patrimonio autónomo) from the Borrower, which is bankruptcy-remote pursuant to Applicable Law.

  • In case the Borrower receives from any of its counterparties any compensation related to the early termination of one or more Lease Contracts or the Operation Contract (including the Lease Contracts and the Operation Contract), the Bank may, at its sole discretion, apply the amount received to the advance payment of the Loan, by sending an instruction to the trustee of the Cash Flow Trust to that effect.

  • The Cash Flow Trust will also include: (i) the Reserve Account to cover debt service (CRSD) equivalent to a period of three (3) months, (ii) the assignment of security deposits associated with the Lease Agreements and, in the case of security deposits granted through guarantees or bonds, the amounts resulting from their execution, and (iii) the assignment of Insurance Policies.

  • The fulfillment of the obligations arising from the Loan shall be guaranteed by: - The Assets Trust, established under the Assets Trust Agreement; and, - The Cash Flow Trust, established under the Cash Flow Trust Agreement.

  • The Cash Flow Trust shall also include: (i) the Reserve Account to cover the debt service (CRSD) equivalent to the amount of the following Installment, and (ii) the assignment of the Insurance Policies.

  • It is the trust estate established under the Cash Flow Trust Contract on the Closing Date, to which the cash flows generated under the Lease Contracts will be transferred.

  • It is the fiduciary estate constituted under the Cash Flow Trust Agreement on the Closing Date, to which the flows generated by the Tenants under the Lease Agreements will be transferred.

  • Structuring Fee: 1.25% of the total principal amount of the Loan, which shall be paid upon disbursement of Tranche A, in accordance with the terms of the Cash Flow Trust Agreement.
