Capped LIBOR definition

Capped LIBOR means, at any time, the rate per annum applicable at such time as set forth on Schedule 1 hereto.
Capped LIBOR means 10.04% per annum; provided, however, that the Capped LIBOR means 9.57% per annum (i) in the event no Registration Event (as defined in the Registration Rights Agreement) occurs on or prior to the 180th day after the Closing Date, from July 1, 1998 through but excluding the date on which such Registration Event occurs or (ii) in the event the Shelf Registration Statement (as defined in the Registration Rights Agreement) ceases to be effective for more than 60 days, whether or not consecutive during any 12-month period, during the period from the 61st day of such applicable 12-month period until such time as the Shelf Registration Statement again becomes effective.
Capped LIBOR means, at any time, 10.0% per annum.

  • If Borrower obtains one (1) interest rate cap, the LIBOR strike rate under the Interest Rate Protection Agreement shall be equal to or less than the Capped LIBOR Rate, or if Borrower obtains more than one (1) interest rate cap, the blended LIBOR strike rate under the Interest Rate Protection Agreement, as determined by Lender, shall be equal to or less than the Capped LIBOR Rate.

  • As a condition to Borrower exercising its right to extend the term of the Loan for any Extension Term, on or prior to the then applicable Maturity Date, Borrower shall (a) extend the term of the Interest Rate Protection Agreement delivered in connection with the closing of the Loan or (b) purchase a new Interest Rate Protection Agreement having a term ending not earlier than the extended Maturity Date and having a strike price equal to the then required Capped LIBOR Rate.
