Capacity Holder definition

Capacity Holder means the person as defined in clause 4.1 of this Rule.
Capacity Holder means the party identified in paragraph 1.3 of Schedule 2;

Examples of Capacity Holder in a sentence

  • The State shall retain its direct or indirect ownership interests in each Alcan Element as provided in Article 7.2 at least until the State Capacity Holder executes a binding precedent agreement to reserve Capacity for all of its expected throughput of State Gas for each respective element, plant or project in the initial Open Season.

  • The Letter of Credit shall be an unconditional irrevocable stand-by letter of credit from a Qualifying Issuer, in a form approved by Channel Cable, in Euro, issued for the account of the Capacity Holder in favor of Channel Cable, allowing for partial drawings and providing for the payment to Channel Cable forthwith on demand by any UK or French clearing bank or such other bank as Channel Cable may approve and which is available for payment at a branch of the issuing bank.

  • If any amount in an invoice is in dispute, then the Capacity Holder must pay the undisputed amount of the invoice.

  • Notwithstanding Clause 2.6, the Capacity Holder will not be entitled to any rebate of, or reduction in, the Capacity Charges on account of any interruption.

  • If at any time following the termination of this Agreement there are no amounts due and payable by the Capacity Holder which are unpaid and no party to this Agreement remains under any obligation actual or contingent the observance or performance of which would give rise to an obligation on the Capacity Holder to make a payment under this Agreement the trust created pursuant to this clause shall be wound up and any monies then held by ▇▇▇▇▇ on such trust shall be returned to the Capacity Holder.
