Capacity Facility definition

Capacity Facility means the [ ] MW electric generation facility to be constructed by Generator as further defined in Attachment A.
Capacity Facility is defined in the third Recital hereof.

Examples of Capacity Facility in a sentence

  • Nothing in this Agreement shall entitle or obligate Utility to purchase or take delivery of capacity, electric energy or ancillary services from the Capacity Facility.

  • Except as otherwise provided in this Section 10, neither party may assign this Agreement without (i) the other party’s prior written consent, such consent not to be unreasonably delayed, conditioned or withheld, it being understood that refusal to consent to the assignment of the Agreement to a Person that does not own or control the operation of the Capacity Facility shall not be deemed to be unreasonable, and (ii) the prior approval of the Board.

  • Generator fails to cause the Capacity Facility to achieve commercial operation by no later than the six (6) months after the Awarded Commencement Date.

  • Generator is willing to commit to offer and clear [ ] MW of unforced capacity of the Capacity Facility into each Base Residual Auction conducted by PJM for all Delivery Years through the Conclusion Date.

  • With respect to Generator, Generator’s supply offer from the Capacity Facility fails to clear in any Base Residual Auction with respect to a Delivery Year during the Delivery Term.

  • Except as otherwise provided in this Section 10, neither party may assign this Agreement without (i) the other party’s prior written consent, such consent not to be unreasonably delayed, conditioned or withheld, it being understood that refusal to consent to the assignment of the Agreement to a Person that does not own or control the operation of the Capacity Facility shall not be deemed to be unreasonable, and (ii) the prior written consent of the Board.

  • With respect to Generator, Generator fails to submit a supply offer for an amount equal to ninety percent (90%) or more of the Awarded Capacity Amount from the Capacity Facility in any Base Residual Auction with respect to a Delivery Year during the Delivery Term.

  • With respect to Generator, Generator fails to submit a supply offer for an amount equal to ninety percent (90%) or more of the Awarded the Available Capacity Amount from the Capacity Facility in any Base Residual Auction with respect to a Delivery Year during the Delivery Term.

  • Any Capacity Facility shall be required to bid no less than the Awarded Capacity Amount beginning with the Base Residual Auction associated with the Awarded Commencement Date and continuing through the Delivery Term, except if an event of Force Majeure delays the Commencement Date.

Related to Capacity Facility

  • City Facility means any building, structure, property, park, open space, or vehicle, owned or leased by the City, its agents, agencies, or departments.

  • Utility facility means any pipe, pipeline, duct, wire line, conduit, pole, tower, equipment or other structure used for one of the following:

  • City Facilities means City or publicly-owned structures or equipment located within the right of way or public easement used for governmental purposes.

  • Liquidity Facilities means, collectively, the Class A Liquidity Facility and the Class B Liquidity Facility.

  • Utility Facilities means the plant, equipment and property, including but not limited to the poles, pipes, mains, conduits, ducts, cable, wires, plant and equipment located under, on, or above the surface of the ground within the public right-of-way of the city and used or to be used for the purpose of providing utility or telecommunications services.   • Energy facility means an energy plant or transmission

  • LNG facility means a terminal which is used for the liquefaction of natural gas or the importation, offloading, and re-gasification of LNG, and includes ancillary services and temporary storage necessary for the re-gasification process and subsequent delivery to the transmission system, but does not include any part of LNG terminals used for storage;

  • Liquidity Facility Provider means a Person that is a party to a Liquidity Facility with the Authority with respect to specified Bonds and whose credit rating by each nationally recognized Rating Agency then rating the Class I Bonds is sufficiently high to maintain the then current rating on such Bonds by such Rating Agency or the equivalent of such rating by virtue of guarantees or insurance arrangements.

  • Majority Facility Lenders with respect to any Facility, the holders of more than 50% of the aggregate unpaid principal amount of the Term Loans or the Total Revolving Extensions of Credit, as the case may be, outstanding under such Facility (or, in the case of the Revolving Facility, prior to any termination of the Revolving Commitments, the holders of more than 50% of the Total Revolving Commitments).

  • Community facility means community room, clubhouse, recreation center or similar area for use by residents. Lobbies and laundry facilities must not be considered within the scope of this definition.

  • Replacement Liquidity Facility has the meaning set forth in the Intercreditor Agreement.

  • Test Facility means any WRAS suitably accredited test laboratory;

  • Replacement Facility means 1 of the following:

  • Existing Facility means a facility in existence on any given date, newly constructed or altered.

  • Community facilities means a specific work, or improvement within this state or a specific item of equipment or tangible personal property owned or operated by any political subdivision or nonprofit corporation and used within this state to provide any essential service to the general public;

  • Processing facility means an establishment that prepares, treats, or converts tangible personal property into finished goods or another form of tangible personal property. The term includes a business engaged in processing agricultural, aquacultural, or maricultural products and specifically includes meat, poultry, and any other variety of food processing operations. It does not include an establishment in which retail sales of tangible personal property are made to retail customers.

  • Class B Liquidity Facility has the meaning set forth in the Intercreditor Agreement.

  • Tanning facility means a place that provides access to tanning devices for compensation.

  • Facility Site shall have the meaning set forth in the recitals to the Facility Site Lease.

  • Facility means the entire operation located on the property where the Equipment is located;

  • nuclear facility means, except as otherwise agreed to by the Underwriter, any of the following, provided that Nuclear Material is contained therein or being used therewith or Nuclear Material is present at the site where the same is located:

  • Treatment facility means an institution (or distinct part thereof) for the treatment of alcoholism or drug abuse, which meets fully every one of the following tests:

  • L/C Facility means the letter of credit facility established pursuant to Article III.

  • Facility or Facilities means any tangible asset in the right-of-way required to provide utility service.
