In France: The substances on the Candidate List are included under the AGEC legislation (LOI n° 2020-105).
In each case, Seller will timely provide Buyer with supporting documentation, including without limitation, (A) pre-registration numbers for each substance; (B) the exact weight by weight percentage of any REACH Candidate List (defined below) substance constituting or contained in the goods; (C) all relevant information that Buyer needs to meet its obligations under REACH to communicate safe use to its customers; and (D) the documentation of the authorization for Buyer’s use of an Annex XIV substance.
The Seller is legally required to declare any Candidate List Substances of very high concern (SVHC) in spares and whole products where present above 0.1% w/w.
Seller will monitor the publication by the European Chemicals Agency of the list of substances meeting the criteria for authorization under REACH (the “Candidate List”) and immediately notify Buyer if any of the goods supplied to Buyer contain a substance officially proposed for listing on the Candidate List.
Should any Products contain Substances listed on the Candidate List that are above 0.1% on a weight by weight basis within that Product, Seller shall provide Buyer with so-called Safe-Use information, pursuant to the provisions of REACH Article 33 and shall maintain the REACH database for the life of this Order.
As indicated, ▇▇▇▇▇ will act in reliance on the statements and commitments Seller makes regarding the Candidate List status of each of the Substances contained in any of the Products.
Seller must provide Buyer with a list of Substances contained in any of the Products that were included on the Candidate List published by ECHA.
Thereafter, if a Substance is added to the Candidate List by ECHA, and that Substance is also contained in any Products, Seller must notify Buyer within fifteen (15) days following publication of the list.
Supplier shall inform Buyer if goods contain substances listed on the European Union’s REACH Candidate List of substances of very high concern available at ▇▇▇▇▇://▇▇▇▇.▇▇▇▇▇▇.▇▇/candidate-list-table or listed on the United Kingdom’s REACH Candidate List available at ▇▇▇▇▇://▇▇▇.▇▇▇.▇▇▇.▇▇/reach/candidate-list.htm or any other similar list in other applicable jurisdictions.
This shall include Local Manufacture Tables (X-File), Ground Support Equipment, Specific-to-type Tools (W-File) and a Pool Item Candidate List (Y-File).
