MSO shall have the non-exclusive right to re-transmit the signals of subscribed Zee Group Channels during the Term via the Cable Television Network in the Territory in an encrypted mode only on the digital “addressable systems” owned and operated by the MSO (the “Platform”) for distribution to Subscribers strictly in terms of and in accordance with the terms of this Interconnection Agreement and applicable Laws including the TRAI Regulations.
For the purpose of this Agreement the DPO shall be reckoned as a licensee of the Broadcaster in terms of Rule 6(3) of the Cable Television (Network Regulations) Act 1995 and further amendments if any, for the retransmission of the Channel(s).
The DPO shall in turn sublicense the LCOs, wherever applicable in terms of Rule 6(3) of the Cable Television (Network Regulations) Act 1995 to retransmit the signals or retransmit the signals directly to the subscribers of the Channel(s) of the Broadcaster in the Areas mentioned in Schedule XI.
MSO shall also not be liable in any manner to Broadcaster/Authorized Distributor or any third party as regards the alleged violations of any third party’s copyrights, any law or any telecast standards and practices guidelines, Programme Code and Advertising Code ( as provided under The Cable Television Network Rules, 1994) or in any applicable law with regard to the Programme Content.
Subject to the Broadcaster fulfilling all the requirements and obligations under this agreement, MSO agrees to carry Broadcaster/Authorized Distributor channel/s as mentioned in Annexure A on their Digital Cable Television Network using its Digital Addressable platform during the Term of this Agreement.
