Building Structural Elements definition

Building Structural Elements means the exterior and interior structures of the Building, including the exterior walls, bearing walls, support beams, foundation, columns, exterior doors and windows and lateral support to the Building. Notwithstanding any of the foregoing to the contrary, Landlord shall have no obligation to maintain any Building Structural Elements or to contribute toward the cost of replacing any Building Systems which were installed by Tenant, or up-graded by Tenant or otherwise modified by Tenant. In addition, notwithstanding anything contained herein to the contrary, Landlord shall have no obligation with respect to any repairs, replacements, additions, alterations and improvements to the roof or Building Structural Elements or Building Systems required by any law, statute code, ordinance, by-law, rule or regulation of any governmental authority due to Tenant's particular use or manner of use of the Premises, which would not otherwise be required and necessary for the average office, warehouse and distribution business.

Notwithstanding any of the foregoing to the contrary, Landlord shall have no obligation to reimburse Tenant for any portion of the costs incurred by Tenant for the replacement of any Building Systems or Building Structural Elements which were installed by Tenant, or up-graded by Tenant or otherwise modified by Tenant. In addition, notwithstanding anything contained herein to the contrary, Landlord shall not be obligated to reimburse Tenant for any costs incurred by Tenant for repairs, replacements, additions, alterations and improvements required by any law, statute, code, ordinance, by-law, rule or regulation of any governmental authority due to Tenant's particular use or manner of use of the Premises which would not otherwise be required and necessary for the average manufacturing business.

Examples of Building Structural Elements in a sentence

  • During the Term, Landlord shall have a continuing obligation to maintain in good order, condition and repair the roof of the Building and the Building Structural Elements (as hereinafter defined) in good order, condition and repair and in accordance with all applicable laws, codes and regulations.

  • With the exception of Landlord's continuing obligation to maintain the Building's roof and Building Structural Elements as set forth in Section 5.2, Tenant shall be responsible to perform all maintenance and repairs necessary to maintain in good order, condition and repair the Premises and all "Building Systems" (as hereinafter defined), at Tenant's sole cost and expense with no contribution from Landlord.

  • During the Term, Tenant shall replace, as necessary, all Building Systems (as defined below) and Building Structural Elements (as defined below).

  • For avoidance of doubt, Landlord, at Landlord’s sole cost without right of reimbursement from Tenant, except to the extent of any damages caused by Tenant or any Tenant Parties, shall be responsible for the necessary and customary capital repairs and capital replacements of the Building Structural Elements.

  • During the Term, Landlord shall ---------------------------------- have a continuing obligation to maintain in good order, condition and repair the roof of the Building and the Building Structural Elements (as hereinafter defined) in good order, condition and repair and in accordance with all applicable laws, codes and regulations.

  • Tenant shall reimburse Landlord for its reasonable out-of-pocket costs in reviewing plans and specifications and Tenant agrees that Landlord has the right to condition Landlord's approval of any Tenant-Made Alterations that affect any Building Structural Elements upon charging a commercially reasonable construction monitoring fee (not to exceed two percent (2%) of the total cost of such Tenant-Made Alterations).
