Building or work definition

Building or work means construction activity as distin- guished from manufacturing, furnishing of materials, or ser- vicing and maintenance work. The terms include, without limitation, buildings, structures, and improvements of all types, such as bridges, dams, plants, highways, parkways, streets, subways, tunnels, sewers, mains, power lines, pump- ing stations, heavy generators, railways, airports, terminals, docks, piers, wharves, ways, lighthouses, buoys, jetties, breakwaters, levees, canals, dredging, shoring, rehabilitation and reactivation of plants, scaffolding, drilling, blasting, exca- vating, clearing, and landscaping. The manufacture or fur- nishing of materials, articles, supplies, or equipment (whether or not a Federal or State agency acquires title to such materi- als, articles, supplies, or equipment during the course of the manufacture or furnishing, or owns the materials from which they are manufactured or furnished) is not “building” or “work” within the meaning of this definition unless conducted in connection with and at the site of such building or work as is described in the foregoing sentence, or under the United States Housing Act of 1937 and the Housing Act of 1949 in the construction or development of the project.

  • All roof penetrations, structural modifications, material revisions to the mechanical, HVAC or electrical systems of the Building, or work affecting portions of the Building outside the Premises or under warranty shall be specifically reviewed and approved by an architect and/or engineer designated by Landlord and shall performed only by contractors approved by Landlord.

  • Tenant further agrees to indemnify, defend, and hold Landlord harmless from and against any and all claims, damages, expenses, and liabilities arising from Tenant’s or its agents, employees, invitees, vendors, contractors or subcontractors use of the Premises or Building or work done thereto which interfere in any way or in any manner with the telecommunications system of any other party.

  • If Landlord gives its consent as specified in Section 8.d. above, Landlord may impose as a condition to such consent (which consent shall not be unreasonably withheld, conditioned or delayed) the right to approve the plans and specifications for any structural work, work that affects the existing mechanical, electrical, plumbing, HVAC or other systems serving the Building or work that is visible from the exterior of the Building or the Common Areas within the Building.

  • Tenant's obligations under Section 8 of the Lease shall exclude structural work to the Building or work to the systems of the Building, unless such work is required by Tenant's improvements or Tenant's use in excess of normal office improvements or normal office use.

  • Tenant further agrees to indemnify, defend, and hold Landlord harmless from and against any and all claims, damages, expenses, and liabilities arising from Tenant’s or its agents, employees, invitees, vendors, contractors or subcontractors use of the Premises or Building or work done thereto which interfere in any way or in any manner with the telecommunications system in the Building.

  • In no event shall approval by the Port Authority of any plans, whether the Conceptual Plan, Construction Plans, Partial Approval Plans or otherwise, impose any liability on the Port Authority to the Lessee or any other Person for any errors or defects contained in such plans or for the failure of the Building or work provided for such plans to comply with any Requirements, any such liability to be that of the Lessee and/or the professionals who prepared such plans.
